Q.    How can I afford an attorney?

A.    The costs and fees of litigation can be substantial.   Because we understand this problem, we handle all cases on a contingency basis.  That means, you do not pay any money to us, and you do not owe any money to us, until we make a recovery for your case.

Q.    How do I pay for the expenses of my case?

A.    Our law firm will advance the expenses.  We will be reimbursed at the conclusion of your case from a portion of the money we recover for you.

Q.    Who will work on my case?

A.    Attorneys will handle your case.  Also, our team of legal assistants and investigators will help the lawyers.  Our law firm is based on our motto:  “We take your personal injury case personally.”

Q.    Can the lawyer settle my case without my knowledge?

A.    No, we will not settle your case unless you authorize it.

Q.    Should I speak with the insurance company?

A.    No, not without your attorney.  Insurance companies are looking out for their best interest, not yours.  Before giving a statement or signing papers, contact us to learn your legal rights.  Many times information given to an insurance company will be used to unfairly minimize your claim.  If you have already spoken to an insurance representative, contact us immediately before dealing with the insurance company further.

Q.    How long will it take to settle my case?

A.    There's no definite time when a personal injury case must be resolved.  It all depends on the unique facts of each case.  Our attorneys and staff will work hard to move your case quickly to a successful conclusion.  Very often cases settle promptly after your medical care is finished and the doctor decides you have reached maximum medical improvement.  Sometimes, it takes more time to properly negotiate a good settlement.  Usually, it is not in your best interest to rush to settlement.

In a small percentage of case, where the insurance company unfairly minimizes your claim or refuses to compensate you, a lawsuit is required.  Once we go to court, it will take longer to conclude your case because of court procedures.

Q.    Will I have to go to court?

A.    Probably not.  Most personal injury claims are settled before a lawsuit is filed.  In a very small number of cases, a lawsuit is necessary to push the insurance company to act fairly.  You will make the ultimate decision about whether to file a lawsuit in your case.  In those cases where a lawsuit is filed, most cases settle before a trial.

Q.    When should a lawsuit be filed?


A.    Usually it makes sense to explore the possibility of settlement before filing a lawsuit.  Rarely settlement negotiations fail and a lawsuit is necessary.

All personal injury cases have a deadline called the “statute of limitation.”  If your case is not settled or brought to court within the statute of limitations, you lose your right to fight your claim.  You should seek legal counsel as soon as possible to determine the statute of limitations and to allow maximum time to fight your claim.
